Unfair dismissal in France

03 March, 2021

In France, the dismissal must be notified in writing, with an explanation of cause, and the date in which it goes into effect.

Additionally, in France, a private interview must be scheduled for the employee to meet with his/her boss.  At this appointment, the boss will explain to the employee the reasons behind his/her dismissal.

If the employee feels the dismissal to be unfair, he/she does have a right to legally challenge it! In court the dismissal will be deemed unfair or invalid if the legal requirements for fair dismissal have not been met, or, if the dismissal has occurred due to discrimination, which is prohibited by law, and violates of the fundamental rights of the employee.
